Terms & Conditions

General Terms

  • Quotations are valid for a period of 7 Days unless otherwise stated.
  • Original manfacturer's warranty applies for all hardware and software.
  • Warranty does not cover abuse and damage either accidental or intentional.
  • Installation work is to be completed during normal business hours (Mon-Fri 9am–5.30pm, excluding weekends & public holidays), unless otherwise stated.
  • Lead times are subject to change without prior notice. Tang Technology shall not be held responsible for changes in the delivery times, pricing or changes in specifications, by a supplier who may bring about change in the terms, conditions and pricing.
  • Original receipt must accompany exchange / return and be in original box with original accessories, packaging, manuals and registration cards in resale-able condition.
  • Refunds are paid in the same manner as original method of payment for purchase, or at Tang Technology's discretion.
  • Store credits are not refundable.
  • Special order items are non refundable.

General Conditions

  • Product must be in undamaged, clean and otherwise new condition.
  • 20% restocking fee may apply
  • Product that is returned incomplete or defaced –if accepted—will require an additional deduction.
  • This deduction is final and subsequent return of missing items will not reverse the deduction.

Property & Risk

  • Upon delivery and/or collection the equipment shall be at the customer’s risk.
  • Notwithstanding the above, both the legal and equitable title in and to the equipment will remain with Tang Technology, until Tang Technology receives payment of the full purchase price together with any tax and interest payable.

Payment

  • Unless otherwise agreed in writing in a relevant proposal,  the client shall make payment in full without any deduction or withholding whatsoever on any account within that period shown on the invoice.
  • Once invoices are 7 or more days over, Tang Technology may suspend or take action to redact any hosting, domain, email or other services related to your customer account without notice.
  • Tang Technology reserves the right to defer without penalty delivery of any equipment which has been ordered by the client so long as any amount remains overdue for payment or any credit limit is exceeded.
  • No claim by the client in respect of the equipment comprised in one delivery of equipment shall entitle the customer to withhold payment of the whole or any part of the price payable in respect of any other delivery of equipment.
  • Once invoices are 30 or more days overdue, Tang may pass on the details of the unpaid invoices to our debt collectors who may act on our behalf. The invoice details passed on will be amended to include any relevant debt collector fees as determined by our debt collection agency. These fees will ultimately be added to the outstanding amount on your account and be requested in full by our debt collector.
  • Failure to pay our debt collection agency may result in action being taken against your credit rating by them. Tang Technology will not be held liable for any implications that this credit rating has on your business or person.
  • An administration fee of $16.50 may apply to Tang Credit Account holders
  • A late payment fee of $150 will be applied to overdue invoices.

Rentals Hardware, Software & Consumables

  • Tang Technology retains all ownership rights to all items supplied to a customer for the period of a rental agreement.
  • All insurance for the items rented are at the client’s own risk.
  • Failure to return all rented items complete, undamaged & original packaging, shall result in additional penalty rental charges at a daily rate to the same value as the rental agreement, per day, per items not returned.
  • Delivery and pickup is not included in the rental charge unless stated in the terms and conditions of sale.
  • Usage of consumables (disks, inks/toners etc) shall be charged to the customer and are not included in the cost of the rental charge.

Consequential Loss

  • Tang Technology hereby expressly excludes to the extent permitted by Law and liability (arising in contract or in tort or however otherwise arising) for:- Consequential loss or damage caused by or arising out of the use of the equipment or occurring in respect of the equipment:- Loss or damage due to due to fair wear and tear and negligence or improper use, operation, storage or handling of the use or operation of the equipment other than strictly in accordance with the products written instructions as supplied with the equipment: Loss, injury or damage arising from fire, accident, industrial dispute, civil disturbance or any other act of accidental default interfering with the manufacture, dispatch or delivery of the equipment and beyond the control of Tang Technology.

Changes

  • Tang Technology may revise these terms and conditions from time to time by posting a new version of this document on our website. Each account is bound by the version of this document that was active as of the date of the initial order or, if the account has been renewed, the version that was active as of the date of the latest renewal, even if the renewal was automated. By renewing or agreeing to have your account renewed, you affirm your acceptance of these terms.

Governing Law

  • These Terms and Conditions of sale shall in respect be governed by and construed within the Laws of the state of Western Australia, and Commonwealth of Australia. The client submits to the nonexclusive jurisdiction of the courts of Western Australia and any courts which may hear appeals from those courts in respect of any proceedings in connection with these terms and conditions.
